Job Summary and Qualifications

Manage managed-care litigation, arbitration and other disputes with managed-care payers on behalf of HCA and its affiliates. Analyze and advise internal clients about potential managed-care claims or disputes, as well as the contractual provisions and terms applicable to those potential claims or disputes. Supervise assigned managed-care staff, including paralegals and contract attorneys.

What you will do:

Manage Managed-Care Litigation and Arbitration (90%)

  • Manage pre-arbitration/litigation process
  • Select and manage outside counsel and experts in connection with litigation and arbitrations;
  • Approve outside counsel’s litigation strategy, including review and approval of motions and briefing, significant discovery, mediation and trial strategy and any appeals, to ensure consistency with client’s business objectives and HCA’s overall policies and business interests;
  • Set budgets and approve invoices based on agreed upon strategy, including in particular budgets for e-discovery;
  • Assist with all phases of discovery on specific cases, including e-discovery, and supervise HCA paralegal regarding same; and
  • Evaluate merits of managed-care cases and claims, and advise business clients, VP of Litigation and General Counsel regarding recommended dispositions and settlements.

Collaborate with and advise business clients on managed-care contracting language and provisions and work with those clients on amendments to managed-care contracts. (8%)

Participate in legal training for business/operational personnel. (2%)

Education & Experience:

  • JD required
  • 10+ years of relevant work experience
  • Managed-care litigation/arbituration experience is required
  • Admitted to, or qualified to be admitted to, the Tennessee Bar
  • Strong analytical and research skills
  • Strong communication skills, oral and written
  • Excellent professional judgment
  • Outstanding interpersonal skills/ability to interact with variety of people, including senior lawyers, business people, judges, arbitrators mediators and support staff
  • Experience with electronic discovery
  • Proficiency in Microsoft Word, proficiency or aptitude for learning PowerPoint, spreadsheet programs (Excel) and litigation computerized database.
  • Some travel required
  • This role requires you to be fully vaccinated for COVID-19 based on local, state and /or federal law or regulations (unless a medical or religious exemption is approved).
