Duties

This position is a developmental (GS-11 Target GS-13) position. This position may be filled at any grade level. Individual selected may be promoted without further competition, upon meeting all legal and regulatory requirements. Starting salary indicated on this vacancy announcement is for the (GS-11). Attainment of knowledge, skills, and abilities is required before promotion to the next higher grade and is dependent on demonstrated ability to perform the duties of the next higher grade level, meeting all regulatory requirements, and recommendation for promotion by the supervisor. Promotion is neither implied nor guaranteed. This position may be subject to a formalized training program and pay retention of 150% of the maximum rate of the basic pay is authorized for candidates requesting a Voluntary Change to lower Grade. Military Spouse candidates exercising their preference will be placed at the full performance level, if considered to be best qualified and selected.
GS-11:

  • Provides advice and legal counsel for designated major weapons system acquisition programs.
  • Reviews contractual documents for legal sufficiency and compliance with applicable laws, regulations, and policy.
  • Examines legal issues raised by requests for formal opinions.
  • Keeps abreast of current knowledge of changing statutory and regulatory guidance relating to designated acquisition systems development, acquisition and sustainment, as well as general developments in technology that improve the effective delivery of legal services.
  • Responsible for the timely completion of administrative duties

GS-12:
  • Conducts legal research and fact-finding, provides legal counsel, advice and support for designated major weapons system acquisition programs.
  • Performs professional legal research and review of contractual documents, contractual forms, and specialized contractual provisions involving millions of dollars under the informal guidance of senior attorneys.
  • Analyzes legal issues raised by requests for formal opinions.
  • Responsible for the timely completion of administrative duties.

GS-13:
  • Chief legal counsel for designated major weapons system acquisition programs and provides program managers and contracting officers a single point of contact for answering legal questions arising from designated programs.
  • Incumbent reviews complex contractual documents for legal sufficiency and compliance with applicable laws, regulations, and policy.
  • Incumbent examines legal issues raised by requests for formal opinions and performs professional legal research and analysis, and renders written and oral opinions on difficult issues of fact and law concerning the legality and enforceability of contracts; interpretation of contractual provisions; resolution of ambiguities; compliance with laws, regulations, and administrative determinations; and resolution of mistakes in bids, protests, contract disputes, and contract claims.
  • Incumbent provides oral advice to Contracting Officers and program management personnel at various levels on pertinent issues
  • Maintain current knowledge of changing statutory and regulatory guidance relating to designated acquisition systems development, acquisition and sustainment, as well as general developments in technology that may improve the effective delivery of legal services.
  • Incumbent is responsible for the timely completion of administrative duties.

  • Incumbent must be a graduate of a law school accredited by the American Bar Association
  • The actual work performed in this position has been reviewed and determined it meets exemption criteria outlined in 5 CFR 551 (a) (3) (c), Learned Professionals; this position has been designated as exempt.

  • The employee must, within 30-days of assuming this position and by 31 October annually, thereafter, file an OGE-450, Confidential Financial Disclosure Report. Employee is required to attend annual ethics and procurement integrity training.

Qualifications

GENERAL REQUIREMENTS:
  • You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).
  • In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as the date obtained is reflected and is dated within 4 months of the date of the application and it shows that you are in "active" status. A copy of the bar card is not acceptable proof of good standing.
NOTE: Transcripts are required to be submitted for the grades that require it.

GS-11 - ADDITIONAL REQUIREMENT: You MUST have one (1) year of professional legal experience OR a second professional law degree (LL.M.)
provided it required at least one (1) full academic year of graduate study OR have superior law student work or activities as demonstrated by one
of the following: 1) academic standing in the upper third of the attorney's law school graduating class; 2) work or achievement of significance on
one of the attorney's law school's official law reviews or journals; 3) special high-level honors for academic excellence in law school (e.g.,
membership in the Order of the Coif, winning a moot court competition, or membership on the moot court team that represents the law school
in competition with other law schools; 4) full-time or continuous participation in a legal aid program, as opposed to one-time, intermittent, or
casual participation; 5) significant summer law office clerk experience; 6) other evidence of clearly superior accomplishment or achievement.

GS-12 - ADDITIONAL REQUIREMENT: You MUST have two (2) years of professional legal experience OR a second professional law degree
(LL.M.) plus one (1) year of professional legal experience at the GS-11 level or equivalent.

GS-13 - ADDITIONAL REQUIREMENT: You MUST have professional legal experience in excess of two (2) years that is commensurate with the
duties and responsibilities of the position.

In accordance with DAFI 90-160, paragraph 1.5 and DAFMAN 90-161, paragraph 9.2.2, as the OPR for DAFI 51-101, I waive the requirement under paragraph 8.11.4 for candidates who have been a bar member for less than five years to provide law school transcripts and statements of class standing at the time of initial application. This waiver applies only to GS-13 (or equivalent) positions and above. It will remain in effect until 15 July 2023, or until the re-publication of AFI 51-101_DAFGM2022-01 (reissued 2 June 2022), whichever occurs first. This waiver does not remove any administrative requirement for selected applicants to provide transcripts at a later time prior to issuing a firm job offer.

KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas:

1.Experience in contract law is preferred but not required.

1. Expert knowledge of federal acquisition law (including but not limited to Systems Acquisition; Research & Development; and, Facilities contracting matters and the Fiscal, Taxation, Environmental, Anti-Trust, and Patents, Copyright, and Technical Data Rights aspects thereof).
2. Maintenance of a current license as an attorney and counselor at law in a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.
3. Demonstrated skill in researching legal issues raised by requests for formal opinions, the analysis of complex factual situations in light of the results of such legal research and general legal principles, and the preparation of written legal opinions and fraud remedies plans based upon such research and analysis.
4. Proven skill in effectively communicating, both orally and in writing.
5. Proven skill in using negotiation techniques to protect the Government's position in major acquisition actions.
6. Ability to conduct oneself in a collegial and professional manner.
